This 2-hour practical training will equip participants with the knowledge, tools, and analytical framework to assess intoxication and incapacitation in Title IX cases.

Determining intoxication versus incapacitation is one of the more challenging and scrutinized aspects of the Title IX process. These findings often get determined upon nuanced evidence, conflicting accounts, and the need to apply policy definitions consistently and without bias. 

Through interactive hypotheticals, real-world examples, and guided discussions, participants will learn how to distinguish between varying levels of impairment, gather the right evidence, and articulate findings that hold up under scrutiny. 

By the end of this session, participants will have a clear process for evaluating impairment-related evidence, confidence to address complex and sensitive cases, and tools to make their determinations fair and consistent.

  • Understanding the difference between intoxication and incapacitation in the context of consent and policy definitions
  • Exploring the physiological and cognitive effects of alcohol and other substances, and how they present in witness statements and physical evidence
  • Identifying key evidence sources: witness accounts, security footage, medical reports, text messages, and social media activity
  • Learning to ask targeted and non-leading questions during interviews to elicit details about a party’s level of functioning
  • Applying a fact-based analysis to determine whether a party could give meaningful consent
  • Recognizing and mitigating the impact of bias, stereotypes, and assumptions 
  • Practicing drafting concise and well-supported findings on intoxication and incapacitation
